A MAN who gave his older brother’s details to police following his arrest in Caernarfon has been spared jail.
Simon Busuttil, 58, of Buckingham Road, Irlam, was sentenced to 20 months’ imprisonment, suspended for two years, at Caernarfon Crown Court on Monday (April 20).
He pleaded guilty to perverting the course of justice last week.
The court heard that, following Busuttil’s arrest on suspicion of drug-driving on in the Tesco car park in Caernarfon on April 9, 2025, he gave a police constable his brother’s name, date of birth and address.
This led to Busuttil’s brother initially being charged instead of him.
In mitigation, Busuttil was said to have a drug addiction, and a partner with stage four lung cancer.
Judge Simon Mills described Busuttil’s offending as “blatant” and “not very sophisticated”.
He warned him that he will “go to prison for a very, very long time” if he repeats his offending.
A two-year driving ban, and 15 days’ rehabilitation activity, were also imposed on Busuttil.
Judge Mills told him: “Behaviour like this has the tendency to undermine the whole system of justice.
“The consequences that your brother faced were really significantly serious.
“This is a real prison sentence that you will have to serve if, during the next two years, you commit any further offence. It will be your choice entirely.
“There will be no mercy whatsoever on the next occasion.”
